DMCA Policy

pickandtested.com respects the intellectual property rights of others and expects its users and partners to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using our website that are reported to our Designated Copyright Agent identified below.


If you are a copyright owner, or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through this website by submitting a DMCA notice containing the information described below.


Filing a DMCA Notice of Copyright Infringement


To be effective under the DMCA, your written notification must include substantially the following:

  • Identification of the copyrighted work you claim has been infringed, or, if multiple copyrighted works are covered by the notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (including the exact URL of the page on which the material appears).
  • Information reasonably sufficient to permit us to contact you, such as your full name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Your physical or electronic signature.

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees.


Designated Copyright Agent

Our Takedown Procedure


Upon receipt of a valid and complete DMCA notice, we will promptly remove or disable access to the allegedly infringing material and take reasonable steps to notify the party responsible for the material, where applicable. Incomplete notices may not be acted upon; we will make reasonable efforts to inform you if your notice is deficient.


Counter-Notification


If material you posted or provided was removed or disabled as a result of a DMCA notice and you believe the removal was the result of mistake or misidentification, you may submit a written counter-notification to our Designated Copyright Agent containing substantially the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If we do not receive notice within ten (10) business days that the original complainant is seeking a court order to prevent further infringement of the material at issue, we may restore the removed material.


Repeat Infringers


It is our policy, in appropriate circumstances, to terminate or restrict access for parties who are repeat infringers of intellectual property rights.
